Welcome to Everyday Parks. These Terms of Service ("Terms") govern your access to and use of the Everyday Parks mobile application (the "App") and any related services (collectively, the "Service").
By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and region
Everyday Parks is intended for use solely within the United States.
- Regional restriction: The App uses location services to verify your presence within the United States. Use of the App outside of this region is prohibited and may result in restricted access.
- Age requirement: You must be at least 13 years of age to use this Service. If you are under 18, you represent that you have the permission of a parent or guardian to use the App.
2. Description of service
Everyday Parks provides information about public parks, amenities, and navigation features.
- Informational purposes only: All map data, amenity listings, and opening hours are provided for informational purposes. While we strive for accuracy, we do not guarantee that the information is complete, current, or correct.
- No safety guarantee: Use of the App for navigation or outdoor activity is at your own risk. Always obey posted signs, local laws, and exercise personal judgment regarding safety and weather conditions.
3. Data and attribution
- OpenStreetMap: Much of the map data and park information is sourced from OpenStreetMap. This data is available under the Open Database License (ODbL). Your use of map data is subject to the terms of the OSM contributors.
- Privacy: Your use of the Service is also governed by our Privacy Policy, which describes how we handle your data, including the use of analytics buffering and anonymized identifiers.
4. Premium subscriptions
Everyday Parks offers a "Premium" tier via in-app purchases through the Apple App Store and Google Play Store.
- Billing: Payments are handled by the respective app store. You agree to abide by their terms of service regarding payments and refunds.
- Cancellations: You may cancel your subscription at any time through your device's account settings. Deleting the App or your local data does not automatically cancel a subscription.
- Features: Premium features, such as ad-removal and enhanced navigation, are provided "as available."
5. Prohibited conduct
You agree not to:
- Use the App for any illegal purpose or in violation of local, state, or federal law.
- Resell, scrape, or "crawl" the data provided in the App for commercial use without express permission.
- Attempt to bypass any regional or age-gating security features.
- Reverse engineer or attempt to extract the source code of the App.
6. Intellectual property
The Everyday Parks name, logo, and the software, excluding OpenStreetMap data, are the exclusive property of Everyday Parks. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
EVERYDAY PARKS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE ACCURACY OF MAP DATA, AVAILABILITY OF THE SERVICE, OR FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYDAY PARKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
This limitation applies to damages resulting from your use or inability to use the Service, or any inaccuracy in the data provided.
9. Governing law
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Everyday Parks is headquartered, without regard to conflict of law principles.
10. Changes to terms
We may update these Terms from time to time. We will notify you of any changes by updating the "Last Updated" date at the top of this document.
Continued use of the App after changes are posted constitutes your acceptance of the new Terms.
